זוכה בחיזוק מכיוונן של שורה ארוכה של הכרזות בינלאומיות , החלטות שיפוטיות וגילויי פרקטיקה מדינתיים מאוחרים יותר שתמכו במעמדה המשפטי המחייב של ההכרזה ( וממלאים על כן הן את דרישת היסוד הפיזי - הפרקטיקה הנרחבת , הממושכת והעקבית , והן את היסוד " הנפשי" - תחושת המחויבות , ( opinio juris ) המצויות בבסיס המנהג הבינלאומי .
